Terms of Use
Klasmate — Learning Centre Management Platform
Effective date: 9 April 2026
1. Agreement to These Terms
These Terms of Use ("Terms") form a legally binding agreement between IT Paradise Digital Solutions ("we", "us", "our") and the education centre, organisation, or individual ("you" or "Centre") accessing or using the Klasmate platform ("Service"). By registering for or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
If you are accepting these Terms on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.
2. Description of the Service
Klasmate is a web-based student and centre management platform that enables education operators to:
The Service is intended for use by authorised staff of education centres. It is not a consumer-facing product and is not intended for direct use by students or guardians.
- Manage student enrolment records, guardian information, and class schedules.
- View consolidated class timetables and manage session capacity.
- Send SMS notifications to guardians using customisable templates.
- Administer multiple centre locations under a single account (where applicable).
3. Account Registration and Access
To use the Service, you must register for an account and provide accurate, complete information. You are responsible for:
We reserve the right to suspend or terminate accounts where we have reason to believe that credentials have been compromised or that the account is being used in violation of these Terms.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Ensuring that only authorised staff members are granted access to your Centre's account.
- Notifying us immediately at it@mobile360.cc if you suspect any unauthorised access.
4. Subscription and Payment
4.1 Plans and pricing
Access to the Service requires an active paid subscription. Available plans, pricing, and included features are set out on the Klasmate pricing page and may be updated from time to time. By subscribing, you agree to pay the applicable fees for your selected plan.
4.2 Promotional pricing
Where a promotional rate is offered at the time of subscription, that rate applies for the promotional period only. At the end of the promotional period, your subscription will automatically renew at the then-current standard rate unless you cancel prior to the renewal date. We will notify you by email before the promotional period ends.
4.3 SMS usage
Each subscription plan includes a monthly allocation of SMS messages. SMS usage beyond the included allocation is charged at the prevailing overage rate per message, as displayed on the pricing page. Overage charges are billed at the end of each monthly billing cycle.
4.4 Billing and cancellation
Subscriptions are billed monthly in advance. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a billing period.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Enter false, misleading, or fraudulent information about students, guardians, or your Centre.
- Use the SMS notification feature to send unsolicited, irrelevant, or harassing messages to guardians.
- Attempt to gain unauthorised access to another Centre's data or to any part of our infrastructure.
- Reverse engineer, decompile, or otherwise attempt to derive source code from the platform.
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the platform.
- Resell, sublicense, or otherwise make the Service available to third parties without our written consent.
- Use the Service in any way that violates applicable Australian laws or regulations.
6. Your Data and Content
6.1 Ownership
All student, guardian, and Centre data that you enter into the platform ("Your Data") remains your property. We do not claim any ownership of Your Data.
6.2 Licence to process
By uploading Your Data to the platform, you grant us a limited, non-exclusive licence to store, process, and use Your Data solely for the purpose of providing the Service to you, in accordance with our Privacy Policy.
6.3 Your responsibilities as data controller
You are the data controller for all personal information you enter into the platform. You represent and warrant that:
- You have obtained all necessary consents from students, guardians, and parents before entering their personal information into the platform.
- You have a lawful basis under the Privacy Act 1988 (Cth) and applicable laws for processing that information.
- You will comply with all applicable privacy laws in your use of the Service.
- You will promptly notify us if you become aware of any privacy breach or complaint relating to data stored in the platform.
7. Data Security and Breach
We implement reasonable technical and organisational security measures to protect data stored on the platform.
In the event of a confirmed data breach affecting Your Data, we will notify you as soon as practicable and no later than 72 hours of becoming aware, and we will cooperate with you in investigating and addressing the breach.
8. Intellectual Property
All intellectual property rights in the Klasmate platform, including software, design, trademarks, and documentation, are owned by or licensed to IT Paradise Digital Solutions. Nothing in these Terms transfers any intellectual property rights to you.
You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes during the term of your subscription.
9. Third-Party Services
The Service integrates with third-party providers, including Google Firebase (infrastructure) and an SMS gateway provider. Your use of the Service is subject to those providers' terms and policies.
We are not responsible for the actions, content, or practices of third-party providers, but we take reasonable steps to ensure that providers who handle personal data are bound by appropriate contractual obligations.
10. Availability and Modifications
We aim to make the Service available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. We may carry out maintenance, updates, or modifications to the platform, and will endeavour to provide advance notice where this involves planned downtime.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. Where changes materially affect functionality you rely on, we will provide at least 30 days' notice.
11. Limitation of Liability
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, consequential, or special loss or damage arising from your use of or inability to use the Service.
- Our total aggregate liability to you in connection with the Service shall not exceed the total subscription fees paid by you in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless IT Paradise Digital Solutions and its directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or third-party right; or (c) Your Data, including any claim that Your Data infringes a third party's rights or was collected without proper consent.
13. Term and Termination
These Terms apply from the date you register for the Service and continue for as long as your subscription remains active. Either party may terminate the agreement:
On termination, your right to access the Service ceases. Your Data will be retained for 30 days following termination to allow for export, after which it will be permanently deleted in accordance with our Privacy Policy.
- You may cancel your subscription at any time in accordance with Section 4.4.
- We may suspend or terminate your access immediately if you breach these Terms, fail to pay applicable fees, or if we are required to do so by law.
14. Governing Law and Disputes
These Terms are governed by the laws of Australia. Any dispute arising in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
We encourage you to contact us in the first instance to resolve any dispute informally before commencing legal proceedings.
15. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you by email or through the platform at least 14 days before the changes take effect.
Your continued use of the Service after that date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
